CHILD CUSTODY and CHILD VISITATIONThere are many types of child custody arrangements that can be established. The most common is one parent being awarded primary residential custody with both having shared parental responsibility so they both have some say in major decisions that affect their child's life. There is also sole legal custody, where only one parent is given the authority to make major life decisions for the children. The main consideration in awarding child custody is, what is in the best interest and welfare of the child. The father of the child is to be given the same consideration as the mother in determining which parent should have child custody. While child custody is awarded as part of the final divorce decree, it can be changed as the circumstances of the child changes and if that change presents an improved situation for the child. Some of the issues that can affect child custody include a parent moving out of state, abuse, re-marriage, and denial of visitation. Child visitation is a very important aspect of a child's life. It is important that the non-custodial parent have liberal child visitation and a schedule for such be established. The schedule provides stability for the child and allows the parents to plan for the child's time and for their own free time. Child custody and child visitation are significant issues to my clients in divorce matters, relocation and custody modification actions. These issues are usually highly emotional. It is important that both parents consider what is in the best interests of the child. I encourage my clients to always keep this in mind. I have extensive experience in handling such matters while trying to minimize the emotional anxiety and concerns.
