Kardashian Wants Divorce to Move Along

Tag: Divorce LawAndrew @ 3:48 am

Kim Kardashian’s attorney told a judge Friday that the reality star wants her divorce from Kris Humphries to move forward but that the case has been slowed by the NBA player’s hurt feelings and his desire for an annulment.

Humphries’ attorneys said they needed more time to gather information to decide whether to pursue allegations that the couple’s 72-day marriage was a fraud. Proving the allegations would likely require a trial, which Kardashian’s attorney Laura Wasser said could prove costly to her estranged husband.

The couple was married last summer in a lavish, star-studded and televised ceremony, but Kardashian filed for divorce on Oct. 31. Humphries responded a month later asking for an annulment, claiming the couple’s nuptials were based on a fraud, but not laying out specific evidence.

“I feel that (Humphries’) personal feelings and maybe some media drive is keeping this case alive,” Wasser said. She said the couple is eligible for a divorce since it has been more than six months since Kardashian filed her petition.

“Certainly, they’ve been separated longer than they’ve been married,” Wasser said.

She said if the case goes to trial and Kardashian wins, she will ask that Humphries

LOS ANGELES (AP) — Kim Kardashian‘s attorney told a judge Friday that the reality star wants her divorce from Kris Humphries to move forward but that the case has been slowed by the NBA player’s hurt feelings and his desire for an annulment.

Divorce Questions: How Does Adultery Affect A Divorce Case?

Cheating

Wondering how cheating could affect your divorce case? Here’s what you need to know, from Katherine Eisold Miller, a collaborative lawyer and family mediator. Have questions? Ask in the comments.

Marriages can end when one member of the couple discovers that the other has had an adulterous relationship. How important is the impact of the extra-marital relationship on the divorce itself? Legally, the answer varies from state to state. In some states, there is very little impact at all while, in others, it can have a substantial influence on the outcome.

Historically, there was a much higher correspondence between adultery and divorce then there is today. Adultery by a woman was often viewed more seriously and punished more harshly than if committed by a man. This remains the case in some countries today, including Iran and Saudi Arabia, where an adulterous wife could face a violent death. In the United States, adultery remains a crime in some states but is rarely prosecuted.

These days, adultery rarely has much of an impact on the distribution of assets — except

Divorce Is Final, No Do-Overs Allowed

Bernard Madoff's mugshot

A few weeks ago, New York’s highest court unanimously confirmed what I’ve been telling my clients for years:

There are no do-overs in divorce.

The court’s decision stemmed from controversy surrounding the divorce of Steven Simkin and Laura Blank, a case that The New York Times described as “one of the most unusual lawsuits resulting from the Madoff fraud — and one that riveted the matrimonial bar.”

What made this lawsuit so remarkable? Well, for starters, Simkin is a partner at one of the country’s most prominent and powerful law firms, and the division of property in this divorce involved millions of dollars of assets. But even so, the Simkin-Blank divorce was settled uneventfully back in 2006, and it’s likely it would have stayed out of the headlines, if not for one thing:

Simkin requested a do-over.

Why did he do that? Well, he requested a do-over because as part of the divorce settlement, the couple split a fortune in excess of $13 million, of which $5.4 million was invested with Bernard Madoff. After the divorce, Simkin continued to keep a

Divorce ceremonies gain traction with parents

Tag: Divorce LawAndrew @ 2:17 am

With this ceremony, I thee… divorce?

Ah, weddings. Most of us have, at some point, been invited by friends or family to share in the joy and celebration of a marital union.

But have you ever been asked to take part in the end of a marriage?

It could be in your future, as some experts are saying divorce ceremonies are the newest way to help children get through their parents’ break-up, and for adults to take that first positive step toward co-parenting together.

Not to be confused with divorce parties which have been gaining steam for a little while now, divorce ceremonies don’t have a band, buffet or much of a celebratory feeling to them. In fact, they’re pretty solemn affairs— all about letting go of your role as romantic partners but affirming your role as a parental unit.

Live Poll

Do you think divorce ceremonies are a good idea when kids are involved?

Dr. Jeffrey Zimmerman, a clinical psychologist and author of The Co-Parenting Survival Guide, has folks write out a series of joint pledges that they say aloud to their kids, and then encourages them to print

Divorce Questions: How Do I Tell My Kids We're Getting A Divorce?

Tag: Divorce LawAndrew @ 2:08 am

Mother Daughter

Wondering how to tell your kids you’re getting a divorce? Here’s what you need to know, from Rosalind Sedacca, the founder of the Child-Centered Divorce Network and author of “How Do I Tell The Kids About The Divorce?” Have questions? Ask in the comments.

Preparing to break the divorce news to your kids? Wondering how to broach the subject and how much to share? How your children will react and how to handle their questions?

Well you’re not alone. Talking about divorce with your children is tough. You don’t want to make errors that you will regret.

There are many common mistakes parents make at this time. Here are five of the most important pitfalls you should avoid:

• Blaming or speaking disrespectfully about your children’s other parent. It creates pain, guilt and confusion for your kids. They wonder, “If there’s something wrong with Dad/Mom, there must be something wrong with me for loving them.” This can damage your parental relationship.

• Pressuring children to make choices. Most kids feel torn when asked to choose between their parents. Don’t put them in that position.

• Assuming that

After Divorce: 8 Tips for Reinventing Yourself

It’s over. You’ve signed the divorce papers, and the relationship you entered with so much hope is officially dissolved.

Everyone’s divorce story is different. Maybe you had been married for decades, maybe just a year or so. Maybe you have children, maybe you don’t. Maybe the divorce was your idea and maybe it was your partner’s, or maybe you both agreed that separation was best. Maybe you’re relieved, maybe you’re heartbroken — or a bit of both.

Decoding Men’s Oddball Love Signals

By Ty Wenger
Fifteen years ago, I found myself in a romantic pickle: Cheryl, a woman I
had been dating for about three months, was nearing her 25th birthday. The
birthday gift in any three-month-old relationship is a dicey one, and I
deliberated over it for weeks. Too big too soon and it could look like I was
trying too hard. Too little and I might appear indifferent. Too romantic and
I’d run the risk of setting the bar too high.
And so it was with great enthusiasm that I finally unveiled…
