 The Florida Bar, the state’s guardian for the integrity of the legal profession, announces that the Florida Supreme Court, in court orders issued between Sept. 7 and Dec. 22, 2011, disciplined 31 attorneys, disbarring 12 and suspending 15. Some attorneys received more than one form of discipline. One attorney was placed on probation; four attorneys were publicly reprimanded and two attorneys were ordered to pay restitution.

Want a divorce? Take a class

Before a married person with children can even file for divorce, they would need to complete a free state “divorce orientation” course, under a bill that cleared its first legislative hurdle Wednesday. The measure also would reinstate a 90-day “cooling-off period” between when someone files for divorce and when it may be finalized.

Both provisions are included in HB290, which the House Health and Human Services Committee approved 5-3 and sent to the full House.

Its sponsor, Rep. Jim Nielson, R-Bountiful, said current law mandates that an orientation course be taken within 60 days after filing for divorce — but people need not complete it until just before the divorce is finalized.

He said the purpose of the course is to help them know all options they face, including ways to possibly save money with arbitration. But if they wait until the process is nearly complete to take the class, he said it cannot help them much.

However, it does allow victims of domestic abuse to file for divorce without the class, to avoid tipping off an abusive spouse that they are considering divorce.

U.S. Court of Appeals Affirms Dismissal of Case Against Venezuelan Government …

NEW YORK, Jan. 31, 2012 /PRNewswire/ – The U.S. Court of Appeals on 1/25/12 affirmed a lower court ruling on behalf of several Venezuelan government officials and businessmen accused of violating the U.S. Racketeer Influenced and Corrupt Organizations Act (RICO).

“The appellate court determined that the allegations in the complaint, which alleged conduct occurring almost entirely in Venezuela, did not trigger U.S. jurisdiction,” said Miami attorney Michael Diaz, Jr. managing partner of the global law firm of Diaz Reus and Targ, LLP. Diaz led the firm’s defense team including partners Carlos F. Gonzalez and Gary Davidson.  

“This case was important because it tested the outer limits of a federal court’s jurisdiction to hear a RICO case based on conduct occurring almost entirely outside of the U.S.,” added Gonzalez.

The current issue of Star Magazine features the cover story of the sad splitting up of the family and dividing the children between them as Will Smith and Jada Pinkett-Smith prepare for divorce. Will married Jada Pinkett in 1997 and together they had a son, Jaden Christopher Syre and a daughter, Willow Camille Reign. Both kids are already big stars in their own right but no doubt feel the pain of their parent’s split.

Divorce 'more stressful for younger people than older generations'

According to Hui Liu, assistant professor of sociology, the findings suggest older people have more coping skills to deal with the stress of divorce.

“It’s clear to me that we need more social and family support for the younger divorced groups. This could include divorce counseling to help people handle the stress, or offering marital therapy or prevention programs to maintain marital satisfaction,” said Liu.

Liu analysed the self-reported health of 1,282 participants in Americans’ Changing Lives, a long-term national survey. She measured the gap in health status between those who remained married during the 15-year study period and those who transitioned from marriage to divorce, at certain ages and among different birth cohorts, or generations.

Liu found the gap was wider at younger ages. For example, among people born in the 1950s, those who got divorced between the ages of 35 and 41 reported more health problems in relation to their continuously married counterparts than those who got divorced in the 44 to 50 age range.

From a generational perspective, the negative health impact was stronger for baby boomers than it was for older generations – a finding that surprised Liu.

DCF speaks out on child neglect case – 7Online WSVN

NORTH MIAMI BEACH, Fla. (WSVN) — New details have been released in the case of a child who was found by police naked and malnourished.

In court Monday, a Juvenile Court judge gave a verbal lashing to the Department of Children and Family for supposedly not catching the signs of abuse in the case of a 9-year-old boy.

Representatives with DCF spoke out Tuesday, defending their department, saying the 9-year-old boy has mental health problems and said a lot of his weight loss occurred in the last two weeks. “I’m in the process now of making sure that we know exactly what happened to this child,” said DCF spokesperon Esther Jacobo.

Photos were released in court of the boy, who weighed about 35 pounds. Police said they found him wandering the streets naked and his body covered in bruises.

In December, DCF said, they were called to a house in North Miami Beach to provide mental health services for the family. “The testimony in court was that the weight loss began about two weeks ago, after we were in the home,” said Jacobo.

Washington, Jan 31 (IANS) Divorce at a younger age is more detrimental to one’s health than later in life as older people can cope better with the ensuing disruption and stress.

Michigan State University sociologist Hui Liu, who led the study said “that we need more social and family support for the younger divorced groups.”

Broward businessman cleared of cigarette smuggling in Miami trial

Arturo Marrero, a Broward real estate developer, was acquitted by a federal judge Monday of conspiring to smuggle cigarettes from Miami to Europe without paying millions of dollars in customs duties.

Marrero, who had two jury trials in Miami federal court, called his experience a “legal nightmare.” One day after his uncommon victory, Marrero said he believes the U.S. attorney’s office and Immigration and Customs Enforcement tried to railroad him.

“How the government assumed that I was a co-conspirator is beyond me,” Marrero, 48, of Davie, said in a statement. “The sad part is that they will go on with their lives as if nothing happened, and my life has been turned upside down because the U.S. government made a mistake.”

In September, Marrero was charged with the smuggling conspiracy and later with money laundering.

The indictment accused him of trying to “enrich himself” by buying cigarettes overseas and hiding the cartons inside textiles and furniture stored in cargo containers at the Port of Miami before shipping them to Portugal, Ireland and Germany.
