Attorney General Bondi, the Federal Trade Commission, and Other States Reach $40 Million Settlement with Skechers

TALLAHASSEE, Fla. –Attorney General Pam Bondi, along with 43 other states, the District of Columbia and the Federal Trade Commission have reached a $40 million settlement today with Skechers USA, Inc., the makers of Shape-Ups, Tone-Ups, and the Skechers Resistance Runner athletic shoes. The settlement resolves allegations that the company made health-related claims in the marketing, packaging, advertising, offering, and selling of its line of rocker-bottom shoe products that were not adequately substantiated at the time the claims were made. Under the settlement, Skechers will pay up to $40 million in restitution to consumers who purchased the shoes. In addition to restitution, the settlement prohibits Skechers from making these claims unless it has adequate substantiation to do so.

“Companies are expected to do their due diligence before making claims about their products,” stated Attorney General Pam Bondi. “This case is an excellent example of state and federal authorities working together to protect consumers.”

The lawsuit alleges that without adequate support, Skechers claimed that the rocker-bottom shoe products caused consumers to lose weight, burn calories, improve circulation, fight cellulite, and firm, tone or strengthen thigh, buttock, and back muscles.

Attorney General Bondi and Other Attorneys General Reach $100 Million Settlement with Abbott Laboratories

TALLAHASSEE, Fla.–Attorney General Pam Bondi today joined 44 other states and the District of Columbia in announcing a $100 million settlement with Abbott Laboratories over allegations of illegal off-label marketing of Depakote. Florida will receive nearly $5 million, and the Illinois-based Abbott will be restricted from marketing the drug for off-label uses not approved by the U.S. Food and Drug Administration. The $5 million will go toward future consumer protection efforts.

“Marketing off-label uses for pharmaceutical drugs is dangerous, and this settlement holds Abbott accountable and protects consumers,” stated Attorney General Pam Bondi.

In a complaint filed today along with the settlement agreement, the states alleged Abbott engaged in unfair and deceptive practices when it marketed Depakote for off-label uses. Depakote is approved for treatment of seizure disorders, mania associated with bipolar disorder and prophylaxis of migraines, but the attorneys general alleged Abbott marketed the drug for treating unapproved uses, including schizophrenia, agitated dementia and autism.

As a result of the states’ investigation, Abbott has agreed to significantly change how it markets Depakote and to cease promoting off-label uses. The company also will pay $100 million nationally.

Attorney General Bondi Will Host the 27th Annual National Conference on Preventing Crime in the Black Community

Tampa, Fla.–Attorney General Pam Bondi will host the 27th Annual National Conference on Preventing Crime in the Black Community from May 16 through May 18 in Tampa. The Florida Attorney General’s Office established the conference in 1986 in order to showcase innovative ideas that encourage crime prevention in the black community. “This conference is the perfect opportunity for law enforcement, local leaders, and members of the community to work together to share new ideas and strategies to prevent crime in our communities,” stated Attorney General Pam Bondi.

The National Conference on Preventing Crime in the Black Community attendees include: law enforcement officers, state agency heads, county commissioners, mayors and city commissioners, victim advocates, educators, community members, and church groups. Attorney General Bondi Announces that Three Defendants Involved in Mortgage Fraud Group Plead Guilty to Racketeering

TALLAHASSEE, Fla. –Attorney General Pam Bondi today announced that three defendants pleaded guilty to racketeering and conspiracy to commit racketeering for mortgage fraud related crimes. Craig Hudson, 40, Lynne Hudson, 35, and Eric Rivero, 39, all residents of Tampa, will be sentenced at a later date for the mortgage fraud scam that involved more than 50 fraudulent mortgages totaling $8.8 million. Craig Hudson faces a maximum sentence of 12 years prison and Lynne Hudson and Eric Rivero each face a maximum sentence of 4 years prison. As part of their plea agreements, the Hudson’s and Rivero will cooperate with authorities in the cases pending against their co-defendants William Bolton and Stephanie Bolton.

“Mortgage fraud directly affects the lending industry and exacerbates Florida’s housing market crisis,” stated Attorney General Pam Bondi. “This case exemplifies our commitment to working together with state and local agencies to stop mortgage fraud in our state,” stated Attorney General Pam Bondi.
